Terms of Service

1. Acceptance of terms

By accessing or using the Eezibuy platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Service. These Terms constitute a binding agreement between you and Eezibuy (Pty) Ltd.

2. Description of service

Eezibuy provides a vehicle finance pre-approval platform that connects buyers with vehicle finance providers and dealerships. We facilitate the pre-approval process but are not a financial services provider, bank, or credit grantor. Final credit decisions are made by registered financial institutions.

3. Eligibility

To use the Service, you must:

• Be at least 18 years of age
• Be a South African resident
• Have a valid South African ID or passport
• Provide accurate and truthful information

4. User obligations

You agree to:

• Provide accurate, complete, and current information
• Maintain the confidentiality of your account credentials
• Notify us immediately of any unauthorised access to your account
• Use the Service only for lawful purposes
• Not attempt to circumvent any security measures

5. Pre-approval and finance

A Eezibuy buying power pass represents a pre-approval estimate based on information you provide. It is not a guarantee of finance. Final approval is subject to the policies and decisions of the relevant financial institution and may vary from the pre-approval estimate.

6. Fees

The Eezibuy platform is free for buyers. Dealers are charged a referral fee per qualified lead as set out in the dealer agreement. Fees are subject to change with 30 days' notice.

7. Intellectual property

All content, trademarks, logos, and software on the Eezibuy platform are the exclusive property of Eezibuy (Pty) Ltd and are protected by South African and international intellectual property laws. You may not reproduce or distribute any content without our prior written consent.

8. Limitation of liability

To the maximum extent permitted by law, Eezibuy shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of income, data, or business opportunities. Our total liability shall not exceed the fees paid by you to us in the preceding 12 months.

9. Indemnification

You agree to indemnify and hold harmless Eezibuy, its directors, employees, and agents from any claims, losses, or damages arising from your breach of these Terms or your use of the Service.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice, if we reasonably believe you have violated these Terms. You may terminate your account at any time by contacting us.

11. Governing law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.

12. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
